2. User Accounts & Responsibilities

You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. You must be at least 18 years old to create an account.

• Probing, scanning, or testing the vulnerability of any system or network.
• Breaching or otherwise circumventing any security or authentication measures.
• Accessing, tampering with, or using non-public areas of the Service.

• Using the Service to store or transmit any content that is infringing, libelous, or otherwise unlawful or tortious.

4. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Obligately Inc. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You retain all rights to the content you submit or upload to the Service, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display it as necessary to provide the Service to you.

5. Fees and Payment

Certain features of the Service may be provided for a fee. You agree to pay all applicable fees in connection with your use of the Service. We reserve the right to change our prices at any time, but we will provide you with advance notice of any price changes. All fees are non-refundable, except as required by law or as otherwise stated in our refund policy.

6. Term and Termination

These Terms will remain in full force and effect while you use the Service. We may suspend or terminate your access to the Service at any time, for any reason, including for any breach of these Terms. You may terminate your account at any time by following the instructions on the Service. Upon termination, your right to use the Service will immediately cease.

7. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Obligately makes no warranties, express or implied, and hereby disclaims all other warranties, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Obligately be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Service.

8. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules. The laws of the State of Delaware, without regard to its conflict of laws rules, will govern these Terms and any dispute that arises between you and Obligately.
